(Chip Somodevilla\/Getty Images)<\/figcaption><\/p>\n<\/figure>\n<p>The claim, which is disputed by an array of legal scholars from across the ideological spectrum, came one week after the Senate Judiciary Committee moved for the first time to advance Democrat-backed legislation that would impose new ethics rules on the justices.<\/p>\n<p>While all nine members of the court have long implied opposition, none has explicitly contested the latest effort to strengthen ethics accountability and transparency \u2014 until now. <\/p>\n<p>\u00ab\u00a0The traditional idea about how judges and justices should behave is they should be mute,\u00a0\u00bb Alito said, according to the Journal. \u00ab\u00a0At a certain point I\u2019ve said to myself, nobody else is going to do this, so I have to defend myself.\u00a0\u00bb<\/p>\n<p><button class=\"link caas-button collapse-button\" data-ylk=\"elm:readmore;slk:Story continues\">Story continues<\/button><\/p>\n<p>The comments drew a sharp response Wednesday from Senate Judiciary Committee chairman Sen. Dick Durbin, D-Ill., who blasted Alito\u2019s \u00ab\u00a0speculative public commentary on a bill that is still going through the legislative process.\u00a0\u00bb<\/p>\n<p>\u00ab\u00a0Let\u2019s be clear: Justice Alito is not the 101st member of the United States Senate. His intervention in Article I activity is unwise and unwelcome,\u00a0\u00bb Durbin said in a statement. \u00ab\u00a0The ethical conduct of Supreme Court Justices is a serious matter within this Committee\u2019s jurisdiction. Ensuring ethical conduct by the justices is critical to the Court\u2019s legitimacy.\u00a0\u00bb<\/p>\n<p>The decision by Alito to wade directly into debate over proposals to reform the court\u2019s ethics standards \u2013 and flatly deny their constitutionality \u2013 appears to breach longstanding norms of public impartiality over matters that could come before the justices.<\/p>\n<p>MORE: Senate committee advances Supreme Court ethics bill after alleged justice misconduct <\/p>\n<p>\u00ab\u00a0Because the Supreme Court possesses the authority to determine the constitutionality of legislative enactments, the Supreme Court itself would appear to have a critical role in determining whether Congress may validly impose a code of ethical conduct upon it,\u00a0\u00bb a nonpartisan congressional analysis concluded earlier this year.<\/p>\n<p>\u00ab\u00a0It is difficult to predict how a challenge to such a code might come before the Court and whether the Court would uphold its constitutionality, as existing judicial precedent offers minimal guidance on how the Court might resolve this constitutional question,\u00a0\u00bb the report reads.<\/p>\n<p>They could similarly choose to abide by a code of conduct imposed by Congress, if one was ever enacted, or they could choose to simply ignore it, experts say.<\/p>\n<p>What would happen next is unclear.<\/p>\n<figure class=\"caas-figure\">\n<div class=\"caas-figure-with-pb\" style=\"max-height: 470px\">\n<div>\n<div class=\"caas-img-container caas-img-lightbox caas-img-loader\" style=\"padding-bottom:67%;\" data-lightbox-src=\"https:\/\/s.yimg.com\/ny\/api\/res\/1.2\/CNmlLnje3ux3RC4iTIen5A--\/YXBwaWQ9aGlnaGxhbmRlcjt3PTI0MDA7aD0xNjAw\/https:\/\/media.zenfs.com\/en\/us.abcnews.go.com\/50873fa2c8fa809e0c816f5f48a528ca\"><span class=\"caas-img-wrapper\"><img decoding=\"async\" class=\"caas-img caas-lazy has-preview\" alt=\"PHOTO: John Roberts, chief justice of the US Supreme Court, during a State of the Union address at the Capitol, Feb. 7, 2023.
